1. Delivery of the Goods

1.1. Delivery of the Goods within Ukraine is carried out by the postal service “Nova Poshta”. The Buyer can choose one of the available delivery methods: to the “Nova Poshta” branches, post office, or courier delivery to the address. Delivery of Goods within the territorial borders of Ukraine is free of charge.

1.2. Delivery of Goods available for dispatch at the time of ordering to other countries is carried out by postal (courier) services at the Seller’s choice. In case of manufacturing the Goods based on individual measurements and parameters of the Buyer or the absence of the Goods in stock at the time of ordering, the method and payment for delivery depend on the chosen delivery country and the model of the Goods. Details and cost of such delivery are agreed upon individually through written correspondence between the Buyer and the Seller.

1.3. The Seller indicates the minimum cost of delivery when placing an Order on the Website.

1.4. The Seller may indicate the approximate cost of delivery of the Goods when placing an Order on the Website or upon the Buyer’s request by sending an email. However, the Seller is not responsible if the actual cost of delivery does not correspond to the Seller’s calculations.

1.5. Upon delivery, the Goods are handed over to the Buyer or the third party specified in the Order (recipient). If the specified persons cannot receive the Goods, the Goods may be delivered to a person who can provide information about the Order and pay for the Goods.

1.6. Before receiving the Order, the Buyer/Recipient of the Goods must check the integrity of the transport packaging, manufacturer’s original packaging, and the integrity of the Goods itself. If the packaging or Goods are damaged or the Goods are missing from the package, the Buyer should inform the employees of the postal (courier) service and draw up an act/complaint. In this case, the Buyer may refuse the Order. Return of the Goods for other reasons is carried out in accordance with the Return of Goods section of the Contract.

1.7. In case delivery of the Goods sent by the Seller fails due to the Buyer’s fault (for example, inability to contact the Buyer, the Buyer is not present at the delivery location, etc.), it is considered that the Buyer wishes to terminate the Contract. In this case, the Contract is considered terminated by mutual agreement of the parties.

1.8. Upon termination of the Contract, the Seller refunds the funds paid for the Goods within 7 days from the date of termination of the Contract.

1.9. In case of impossibility to deliver customized Goods based on individual measurements and parameters of the Buyer, the Seller is not obliged to refund the Buyer the funds paid for such Goods.

2. Guarantees and Returns of Goods

2.1. The Buyer has the right to refuse the Goods of proper quality and terminate the Agreement within 14 (fourteen) calendar days, excluding the day of purchase of the Goods, if the Goods do not satisfy them in terms of form, dimensions, style, color, size, or for other reasons cannot be used for their intended purpose.

2.2. Exchange or return of Goods of proper quality is possible if such Goods have not been used, the commercial appearance and consumer properties are preserved, seals, labels, there are no signs of wear, washing, non-characteristic odors, etc., on the Goods.

2.3. For the return of the Goods, the Buyer must keep the packaging and all usage instructions in their original condition and in their original attachment (sewn, on branded tape, etc.), as well as the original payment document (cash receipt) issued to the Buyer together with the Goods (SMS notifications of funds withdrawal and/or witnesses’ statements are not payment documents within the meaning of current legislation).

2.4. Return of Goods of proper quality is possible subject to compliance with all the above conditions.

2.5. The Buyer cannot refuse the Goods, terminate the Agreement, or exchange the Goods for another one in cases where the Goods are not subject to exchange and return according to Article 9 of the Law of Ukraine “On Protection of Consumer Rights” and the resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994, No. 172 “On the Implementation of Certain Provisions of the Law of Ukraine “On Protection of Consumer Rights”.

2.6. If an identical Goods for exchange are not available for sale at the time of exchange, the consumer has the right to either purchase any other Goods from the available assortment with a corresponding recalculation of the cost or receive a refund in the amount of the returned Goods’ value or exchange the Goods for an identical one upon the first arrival of the corresponding Goods for sale. The Seller is obliged to notify the Buyer on the day of the Goods’ arrival for sale, who demands the exchange of the Goods.

2.7. If the Buyer received Goods of improper quality, they have the right to contact the Seller within 30 days, unless another period is stipulated by the Agreement, with a demand to return the paid amount for the Goods or replace the Goods with an identical one.

2.8. Goods of improper quality are Goods with significant defects or Goods that do not correspond to the characteristics declared by the Seller, and these defects did not arise due to violations of the rules of storage or use of the Goods. Differences in design elements or decoration from those stated in the description on the Website are not signs of improper quality.

2.9. The Seller is not responsible for the defects of the Goods that occurred after their transfer to the Buyer, due to the Buyer’s violation of the rules of use or storage of the Goods, actions of third parties, or force majeure.

2.10. In order to initiate a return, please contact us via email info@nadyadzyak.com and agree and coordinate the returning procedures with our manager

The Buyer must include a payment document in the package, as well as other documents required according to item 2.3, and send the Goods through the postal service in packaged form. The service does not check the contents of the package. The Buyer is solely responsible for the contents of the package, documents, and the condition of the Goods.

2.11. The Seller checks the Goods and accompanying documents and informs the Buyer of their agreement to return the Goods or refusal.

2.12. In case of agreement, the money is returned to the Buyer within 7 (seven) days. The method of refund is determined by the payment method.

2.13. In case of refusal to return, the Seller does not return the Goods, and informs the Buyer of the address and conditions for picking up the Goods. If the Buyer does not pick up the Goods within 30 days, such actions are considered the Buyer’s refusal of ownership rights to the Goods under the provisions of Part 1 of Article 347 of the Civil Code of Ukraine, and the Seller has the right to dispose of the Goods at their discretion.

2.14. Return of Goods of proper quality is at the expense of the Buyer, and return of Goods for the reasons specified in item 2.7. of the Agreement is at the expense of the Seller.

2.15. The Buyer has the right to return Goods received abroad. To coordinate all the details regarding the return, the Buyer must leave a request on the Seller’s Website or contact the Seller directly by email or through messengers.

2.16. The warranty period for any Goods is 30 days from the date of receipt of the Goods by you, unless otherwise specified by the Seller.
